1. Agreement to Terms
By using Next Systems services, you agree to these terms. "Next Systems" refers to Next Systems Pty Ltd (ACN 682 443 161).
2. Service Description
Next Systems provides AI-powered telephone receptionist services. Our AI receptionist answers incoming calls, qualifies enquiries, books appointments, and sends notifications. The service is powered by artificial intelligence and is not a human receptionist.
3. AI Disclaimer
Our AI receptionist is designed to handle common call scenarios accurately. However, as an AI system, it may occasionally misunderstand callers, provide incomplete information, or handle edge cases imperfectly. We continuously improve our AI but cannot guarantee error-free performance. Important or sensitive communications should be verified by a human team member.
4. Account and Access
- You must provide accurate business information during onboarding.
- You are responsible for maintaining the security of your account credentials.
- You must not share access with unauthorised parties.
5. Pricing and Billing
- Subscriptions are billed monthly in advance via Stripe.
- Prices are in Australian dollars and include GST.
- Overage minutes are billed at the end of each billing period.
- Setup fees are charged once at the start of service.
- We reserve the right to adjust pricing with 30 days written notice.
6. Acceptable Use
You must not use the service to:
- Handle calls involving illegal activities
- Collect information for spam or unsolicited marketing
- Misrepresent the AI as a human when directly asked
- Overwhelm the system with automated or fraudulent calls
- Violate any applicable Australian law
7. Data Ownership
You retain ownership of all business data, call recordings, transcripts, and caller information. We do not claim ownership of your data. Upon termination, you may request a data export within 30 days.
8. Intellectual Property
The AI receptionist technology, software, algorithms, and platform are the intellectual property of Next Systems. Your subscription grants a non-exclusive, non-transferable licence to use the service.
9. Service Level
We aim for 99.9% uptime. Scheduled maintenance will be communicated in advance. We are not liable for outages caused by third-party providers, force majeure, or issues with your phone system.
10. Limitation of Liability
Total liability is limited to fees paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages, including lost revenue from missed calls during service outages.
11. Termination
Either party may terminate with 30 days written notice. Your AI receptionist will be deactivated and data retained for 90 days, then permanently deleted.
12. Dispute Resolution
Disputes will first be attempted through good-faith negotiation. If unresolved, referred to mediation in Sydney, NSW. Governed by the laws of New South Wales, Australia.
13. Changes to Terms
We may update these terms with 30 days notice via email. Continued use after the notice period constitutes acceptance.
